Brainy Kids - Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") are a legal agreement between you and Mochi Games Studio ("we", "us", "our") governing your use of the Brainy Kids (also listed as "Brainy Kids Academy") app and any optional purchases within it (together, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App. If you are a parent or guardian setting up the App for a child, you accept these Terms on behalf of yourself and your child.

2. The Service

Brainy Kids is a brain-training app for all ages. It includes:

• A free core — the original twelve games and their daily challenges, available at no cost, with no advertising and no tracking.
• Brainy Kids Plus — an optional paid subscription that unlocks additional games, content, and advanced features.
• Content packs — optional one-time purchases that add extra data such as word lists, images, or themes.

We may add, change, or remove games, content, and features over time.

3. Brainy Kids Plus Subscription

• Auto-renewing. Brainy Kids Plus is offered as an auto-renewable subscription on a monthly or yearly basis. The price shown in the App Store at the time of purchase applies.
• Free trial. If a free trial is offered and you accept it, the trial converts to a paid subscription automatically at the end of the trial period unless you cancel at least 24 hours before the trial ends. If you have previously used a trial for this subscription, you may not be eligible for another.
• Billing & renewal. Payment is charged to your Apple account at confirmation of purchase. The subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Managing & cancelling. You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID settings (Settings → your name → Subscriptions). Deleting the App does not cancel a subscription.
• Price changes. If we change the subscription price, Apple will notify you and, where required, ask for your consent before the new price takes effect, in accordance with Apple's rules.
• Family Sharing. Brainy Kids Plus may be shared with your Apple Family Sharing group where supported.

4. Content Packs

Content packs are optional one-time purchases that add data only (such as word lists, images, avatars, or themes). They are not separate games, are non-refundable except as required by law or by Apple's policies, and are tied to the Apple account used to buy them. Active Brainy Kids Plus subscribers receive included content at no additional charge as described in the App.

5. Our Free-Core Promise

The original twelve games and their daily challenges are free and will remain free. We do not show advertising, and we do not lock the free core behind a paywall. Optional purchases only ever add to the experience.

6. Licence to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own and your family's non-commercial use, in accordance with these Terms and the App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or distribute the App except as permitted by law.

7. Acceptable Use

You agree to use the App lawfully and not to attempt to disrupt, circumvent purchase or parental controls, or interfere with the App's security or intended operation.

8. Children & Parental Responsibility

Brainy Kids is designed to be safe for children. Purchase screens and links to external websites are placed behind a parental gate so a child cannot make a purchase or leave the App's child-facing experience without an adult. Parents and guardians are responsible for supervising children's use of the App, for any purchases authorised on their Apple account, and for configuring device controls such as Screen Time, Ask to Buy, and Family Sharing. We do not knowingly collect personal information from children or anyone else; please see our Privacy Policy.

9. Intellectual Property

The App, including its games, design, text, graphics, and sounds, is owned by Mochi Games Studio or its licensors and is protected by applicable intellectual-property laws. These Terms do not transfer any ownership rights to you.

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that it will achieve any particular educational result.

11. Limitation of Liability

To the maximum extent permitted by law, Mochi Games Studio will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.

12. Changes to the App and These Terms

We may update the App and these Terms from time to time. When we change these Terms, we will update the "Last updated" date at the top of this page. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

13. Termination

You may stop using the App at any time and delete it from your device. We may suspend or end your access to paid features if you breach these Terms. Cancelling a subscription stops future renewals; it does not retroactively refund the current period except as required by law or Apple's policies.

14. Governing Law

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection laws of your country of residence.

15. Apple App Store — Additional Terms

Because you obtained the App through Apple's App Store, the following additional terms apply:

• These Terms are between you and Mochi Games Studio only, and not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility.
• We, not Apple, are responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
• We, not Apple, are responsible for investigating, defending, settling, and discharging any third-party claim that the App or your use of it infringes that third party's intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
